PM and Ministers to Lose Post After 30 Days in Jail : if they charge with serious criminal cases.

In what is being described as a landmark step to tighten political accountability, the Centre on Tuesday introduced three significant bills in Parliament aimed at reshaping the rules of governance. The draft legislation proposes that the Prime Minister, Chief Ministers, and Union or State ministers will be automatically stripped of their posts if they remain in judicial custody for 30 consecutive days on serious criminal charges. The move seeks to address long-standing concerns over leaders accused of grave offences continuing to occupy high public office, and is being hailed as a bold push toward cleaner politics and greater transparency in public life.

According to the draft provisions, any Prime Minister, Chief Minister, or Union or State minister detained under charges that attract a minimum punishment of five years will automatically be deemed to have vacated their office on the 31st consecutive day of custody. The provision is designed to ensure that individuals facing serious allegations are not allowed to continue in positions of power while under prolonged judicial scrutiny. Political analysts have described the move as a bold and unprecedented attempt to draw a firm line between governance and criminal accountability, thereby strengthening public trust in democratic institution

Union Home Minister Amit Shah introduced the three bills in Parliament, underscoring the government’s commitment to strengthen political accountability. He recommended that the proposals be referred to a Joint Parliamentary Committee (JPC) for detailed examination. The JPC, a multi-party panel of lawmakers, plays a crucial role in scrutinizing bills clause by clause, gathering expert opinions, and ensuring that the proposed legislation is thoroughly debated before being brought back to the House for passage. If these bills are eventually cleared, they would mark a historic shift in India’s political framework by preventing leaders in prolonged custody from continuing to hold office, thereby tightening the checks on those in power.
